The following general terms and conditions of sale detail the rights and obligations of the company Roches Rouges and its customer in the context of the sale of products on the website www.rochesrouges.com, whether the buyer is a professional or consumer.

Any service provided by the company Roches Rouges implies the unconditional acceptance of these general terms and conditions of sale by the buyer.

No other general or specific conditions not expressly agreed upon by the company Roches Rouges shall prevail hereunder.

Products:

As our products are handmade, they may differ from the photographs presented on our website. Additionally, computer screen settings and lighting conditions during shooting may also alter the colors or appearance of the product.

Stones may exhibit irregularities and slight size differences as each gem is handcrafted and therefore unique. These differences should not be considered major defects, and Roches Rouges cannot be held responsible.

Prices:

The prices of the goods sold are those in effect on the day of the order. They are quoted in euros and calculated all taxes included (VAT) taking into account the applicable VAT on the day of the order.

Displayed prices do not include shipping costs applicable on the day of the order.

Shipping costs are calculated based on the geographical zone of the merchandise destination and are mentioned during the payment process.

Roches Rouges reserves the right to modify its prices at any time. However, it undertakes to invoice the ordered goods at the prices indicated at the time of order registration.

The proposed rates include any discounts and rebates that Roches Rouges may grant.

Geographical Zone:

For sales outside the European Union and in the Overseas Territories, Roches Rouges cannot anticipate customs fees. The buyer declares themselves as the importer.

Order:

After selecting products, the buyer must fill in the necessary information to identify themselves. After validating the order, they will proceed with the immediately payable payment. The order will be confirmed once the payment is validated. This confirmation implies the acceptance of these general terms and conditions of sale. A confirmation email will be sent to the email address provided in the identification form.

Our jewelry is exclusively handmade in our workshop in Marseille, so quantities are very limited. Some products are made after order validation. The manufacturing time may vary between 3 days and several weeks depending on the ordered product. The sum paid at the order validation is not considered a deposit, within the meaning of Article 1590 of the Civil Code.

If the buyer wishes to obtain an invoice indicating VAT, they must request it by email to [email protected] (subject: INVOICE).

Payment:

Payment is made by credit card via the secure platform provided by SquareSpace, the host of this website, namely STRIKE. No banking details are stored or collected.

Transfer of Ownership:

Roches Rouges retains ownership of the goods sold until full payment of the price, both principal and accessories.

Withdrawal:

The buyer has a withdrawal period of fourteen days from the receipt of their order. They must return the merchandise to the seller within this period. Transport costs are at their expense.

Upon receipt, the seller will refund the merchandise within thirty days, excluding initial shipping costs. The refund will be made to the account associated with the payment card.

The product must not have been worn or damaged and must be returned in its original packaging.

If the above conditions are not met, the seller will not proceed with the refund. The buyer can then, at their expense, request the return of the product in its original condition.

Delivery:

Packages are shipped within 2 to 5 working days after the products are made.

Transport is carried out by La Poste with tracking. The tracking number is provided by email following the shipment of the order.

Any damage caused during transport must be reported to the carrier.

Roches Rouges is not responsible for the carrier's failure to meet delivery deadlines.

Warranty:

All products sold on this website are guaranteed for thirty days from the date of receipt and benefit from the legal conformity guarantee provided for in articles L.211-4 to L.211-13 of the Consumer Code and the legal guarantee of hidden defects provided for in articles 1641 to 1648 of the Civil Code.

To activate the warranty, the buyer must send an email to [email protected] (subject: WARRANTY).

Intellectual Property:

All elements composing this website, www.rochesrouges.com, are the exclusive property of the company Roches Rouges.

Personal Data:

The personal information provided on our site is subject to automated processing.

Your data is used by Roches Rouges for order processing and may also be used for prospecting unless the buyer objects in writing by sending an email to [email protected] (subject: INFORMATION).

The buyer can modify their personal information by sending an email to [email protected] (subject: INFORMATION).

Force Majeure:

Roches Rouges's responsibility cannot be invoked if the non-performance or delay in the performance of one of its obligations described in these general terms and conditions of sale results from a case of force majeure. In this regard, force majeure refers to any external, unforeseeable, and irresistible event within the meaning of Article 1148 of the Civil Code.

Competent Court:

Any dispute regarding the interpretation and execution of these general terms and conditions of sale is subject to French law.

In the absence of an amicable resolution, the dispute will be brought before the legally competent court in Marseille.
